can i pick a track more than once.

=> yes, twice as the maximum in fact should be the best way, but if your opponent is ok wth 3 times the same track (version, means for ex. vineta rev x3) why not? But he could refuse that, twice max remaining as default settings.

can i pick the same track on different speed classes
=>Of course, just try to stay as I said, with twice the same track version, for more fairness

what happens if i pick rapier races and my opponent refuses say he is phantom only...
=>Custom battle is default mode, means you're choosing 3 rounds, & your opponent is choosing 3 rounds. That's all, you must own his playground, and he must do the same for the win. All-round player style!

what happens if there is no aggreement..
=>The only points that could lead to a disaggreement are :
-zone targets (please report to the first post of this thread for optional zone target settings)
